Regulatory Alert: EPA Extends Comment Period for Proposed 2026 MSGP for Stormwater Discharges

Today, the U.S. Environmental Protection Agency (EPA) extended the deadline for submitting responses to the agency’s proposed multi-sector general permit (MSGP), which would, if finalized, outline the terms and conditions for authorizing certain airports to discharge industrial stormwater. The new deadline for airports and the public to respond to the proposed MSGP is Friday, April 4, which is a 52-day extension from the original February 11 deadline.
The current EPA MSGP that applies to industrial stormwater discharges went into effect on March 1, 2021, and is set to expire on February 28, 2026. EPA must release another MSGP—or extend the existing general permit—before the 2026 expiration date. In December, EPA released the proposed MSGP for public comment. Unfortunately, the proposed permit contains some troubling new requirements, including quarterly testing of stormwater discharge points for 40 different PFAS compounds and three other “parameters.” EPA also requested comments on whether PFAS-related thresholds should be established that, if exceeded, would require corrective action.
