Rep. Salud Carbajal (D-CA) to Offer Amendment to Strike PAPA Provisions from ALERT

We need your help now to urge House T&I committee members to back an amendment from Rep. Salud Carbajal (D-CA) to strike AOPA-backed provisions (Section 105) in the modified Airspace Location and Enhanced Risk Transparency (ALERT) Act that would prevent airports from using ADS-B to collect any revenue from operators including takeoff and landing fees or to initiate an investigation. As we reported last night, the T&I committee plans to consider the modified ALERT Act, including the PAPA provisions in Section 105, tomorrow at 10:00 a.m.
 
Urgent Request: If your House member is on the T&I committee or if you have a member from your state on the committee (see full roster below), please contact them as soon as possible and urge them to support the Carbajal amendment to strike Section 105 from the modified ALERT Act when the measure is considered tomorrow morning. Draft talking points:

  • We urge Rep. XXX to support the Carbajal amendment to strike Section 105 from the modified ALERT Act that the House T&I committee is scheduled to consider tomorrow.

     

  • The Section 105 provisions would prohibit the use of ADS-B technology by airports to collect fees or initiative investigations.    

     

  • If adopted, these provisions would limit the ability of our airport and others to charge users for the use of our facility and impair efforts to fund airport operations and safety-critical infrastructure projects.

     

  • These provisions would also limit the ability of our airport to hold users accountable for safety and noise-related violations that may occur.

  • Notably, the Section 105 provisions have been added without the benefit of a hearing or any committee consideration, and they have significant impacts on airports and their ability to pay for necessary safety upgrades and meet federal requirements.  

 

We continue to work with committee offices on other potential amendments that could mitigate the impacts of Section 105. If other positive amendments materialize, we will be seeking further help to encourage their adoption so stay tuned for further updates.
